Extract from the General Terms and Conditions of Contract and Travel
- 1. registration, confirmation, payment
Your written or telephone registration is binding. The travel contract between you and us is concluded with the unconditional acceptance of your registration. Unless otherwise agreed, the trip must be paid for at least 30 days before departure. In the case of bookings made at short notice, the entire invoice amount must be paid immediately, within 3 days at the latest, and the receipt must be sent to us immediately. If we are unable to receive payment at least 29 days before departure, we are entitled to cancel the trip for a fee in accordance with our cancellation conditions. For individual trips, charter flights, scheduled flight tickets or other services that are payable immediately, the terms of payment of the respective service provider apply. For cruises, a deposit of up to 90% of the tour price is due immediately, with the balance payable no later than 30 days before departure. If the down payment or final payment is not made on time, we have the right to withdraw from the contract without compensation and to demand the cancellation costs in accordance with section 2.2.
1.1 In addition to the prices mentioned in the catalogue, your booking office may charge an additional order fee for dossier processing and reservation. - 2. changes to bookings or cancellation of the trip by the travellerAlle All changes or cancellations must be made in writing. We expressly draw your attention to the strict fare regulations of the airlines and of the airlines and shipping companies. For rebookings, name changes and cancellations high fees (up to 100%) will be charged. These will always be charged in addition to the processing fees and any cancellation insurance.
- 2. changes to bookings or cancellation of the trip by the traveller All changes or cancellations must be made in writing.
We expressly draw your attention to the strict fare regulations of the airlines and shipping companies. High fees (up to 100%) are charged for rebookings, name changes and cancellations. These will always be charged in addition to the processing fees and any cancellation insurance.
2.1 In the event of name changes, nomination of a replacement traveller or other changes of the travel dates up to 31 days before the departure date, we charge a processing fee of CHF 60 per person. After this period, the cancellation conditions in section 2.2 apply. Processing fees are not covered by cancellation protection or insurance.
2.2 If you cancel your trip before departure, we will charge a processing fee of of CHF 60 per person. The processing fees are not covered by the compulsory cancellation insurance or cancellation cover.
If you cancel your coach package tour less than 30 days before departure, the following cancellation or amendment costs will be charged in addition to the processing fees:
30-21 days before departure: 10% 20-15 days before departure: 30% 14-01 days before departure: 80% 01 days – no-show: 100%
For all other travel variations, such as scheduled flights, ocean cruises, river cruises, individual trips of all kinds, third-party arrangements or motorsport trips, different cancellation costs apply. These will be charged individually according to the circumstances.
2.3 If you cancel your Domo river cruise package tour before the start of the trip, the following cancellation or amendment costs will be charged in addition to the processing fees:
River cruises with a duration of up to 9 days
59-46 days before departure: 15% 45-31 days before departure: 25% 30-16 days before departure: 50% 15-6 days before departure: 80% 5-0 days before departure: 100%
River cruises with a duration of 9 days or more
89-60 days before departure: 25% 59-31 days before departure: 50% 30-11 days before departure: 80% 10-0 days before departure: 100%
2.4 Tickets for sporting and cultural events and the associated hotel services will be charged in full in the event of rebookings or cancellations.
2.5 The date of receipt of your registered message by us is decisive for calculating the deadlines; in the case of arrival at weekends or on public holidays, the next working day is decisive. - 3. cancellation costs and SOS return travel insurance
Compulsory cancellation and SOS return travel insurance is not included in the package prices and is charged separately (see price details). Please refer to the insurance certificate for details of the insurance benefits. If you already have your own cancellation costs and SOS return travel insurance, you can waive this insurance in writing at the time of booking. - 4. Entry requirements
You will find the entry requirements for Swiss citizens in the brochure or the travel programme. Information on entry requirements for citizens of other countries and the fulfilment of these requirements is the responsibility of the respective participant. Participants are responsible for complying with these regulations and for carrying the necessary travel documents (such as passport, identity card, etc.). Please check that the travel documents and the programme description are complete and correct before departure. We would like to draw your attention to the fact that if you are refused entry, you will be liable for the full cost of your return journey. We expressly draw your attention to the legal consequences of prohibited goods and/or other imports and exports. - 5. Programme and price chan
5.1 Changes before conclusion of the contract We expressly reserve the right to change brochure details, service descriptions and prices in the brochures and on the price lists prior to your booking. Should this be the case, your booking office will inform you of these changes before the contract is concluded.
5.2 Price changes after conclusion of the contract In exceptional cases, the agreed price may have to be increased. Price increases may be due to the following reasons:
a) the subsequent increase in transport costs, e.g. fuel surcharges;
b) newly introduced or increased government levies or fees (such as airport taxes, landing fees, embarkation and disembarkation fees, etc.) or the introduction of a fee to secure customer funds in accordance with the Federal Package Travel Act;
c) changes in exchange rates
d) government-imposed price increases (e.g. value added tax). If the costs of these travel services increase, these may be passed on to you. The tour price will increase accordingly. We will implement the price increase no later than 15 days before the start of the holiday. If the price increase is more than 10 per cent, you are entitled to the rights mentioned in section 6.4.
5.3 Programme changes, changes in transport after your booking and before the start of the tour
We reserve the right, also in your interest, to change the travel programme or individual agreed services (e.g. accommodation, type of transport, means of transport, airlines, flight times, etc.) if unforeseeable or unavoidable circumstances make this necessary. We will endeavour to offer you equivalent replacement services. We will inform you of such changes and their impact on the price as soon as possible.
5.4 Your rights if the travel price is increased after conclusion of the contract, or if changes are made to the programme or transport If the programme change or the change to individual agreed services leads to a significant change to an essential point of the contract or if the price increase is more than 10 percent, you have the following rights:
a) You can accept the change to the contract;
b) You can withdraw from the contract in writing (registered letter only) within 5 days of receiving our notification, and you will receive a refund of the travel price already paid in the form of a voucher or payment by our choice;
c) Or you can inform us in writing within 5 days of receipt of our notification that you wish to take part in an equivalent alternative tour proposed by us. We will endeavour to offer you such a trip. If the alternative trip is cheaper, the price difference will be refunded to you in the form of a voucher or payment by our choice. If you do not send us a notification in accordance with letters b) or c), you agree to the price increase, the programme change or the change to individual agreed services (the 5-day deadline is met if you send your notification by Swiss post on the 5th day). - 6. Trip cancellation by Domo
6.1 Group size
A minimum number of participants applies to our trips. If this minimum number of participants is not reached, we reserve the right to cancel all trips lasting 2 days or more at least one day before the start of the trip without compensation. In the case of day trips, this deadline is one day before the trip at the latest.
6.2 Compelling reasons If compelling reasons such as force majeure, unrest, strikes, government measures, epidemics, pandemics, etc. prevent the trip from taking place, we will inform you of the cancellation as soon as possible.
6.3 In both cases, we will endeavour to offer you a replacement trip at a later date. If you do not take part in this trip, we will issue a travel voucher for the amount of your payment or issue a credit note. We are authorised to deduct expenses of any kind already incurred from the payment made and to take them into account in the credit notes. Further claims on your part are excluded in full. - 7. Programme changes, cancellation of services during the tripMüssen If programme changes have to be made during the trip, we will endeavour to offer an equivalent replacement service / alternative. If the programme is objectively reduced in value as a result of the programme change, we will reimburse you with a voucher. If unforeseen necessary changes to the programme result in additional costs because, through no fault of our own, no equivalent replacement service or equivalent return transport option is available and the measure is in the objective interest of the customer, these additional costs shall be borne by the customer. During the trip, the customer is only entitled to a right of cancellation if a significant part of the agreed services cannot be provided and no suitable alternative can be offered or the customer refuses the replacement service for important reasons.
- 8. trip cancellation by the customer
If you cancel the trip, the travel price cannot be refunded; any additional costs (e.g. return transport) will be borne by you. If you have to cancel the trip for compelling reasons (illness, accident, etc.), our tour guide or our chauffeur/tour guide will help you organise your return journey to the best of their ability. - 9. trip cancellation by Domo
Should compelling reasons such as force majeure, natural disasters, unrest, warlike events, strikes, epidemics, pandemics, etc. force us to cancel the trip, no reimbursement will be made for services not provided. Any additional costs (e.g. return transport) must be charged to you. The choice of a more expensive alternative service that was in your interest (e.g. scheduled flight instead of charter flight) must be borne by you. - 10. Ombudsman
10.1 You should contact the independent travel industry ombudsman before taking legal action. The Ombudsman will endeavour to reach a fair and balanced agreement on any kind of problem between you and us or the travel agency with which you booked the trip. 10.2 The Ombudsman’s address is: Ombudsman of the Swiss Travel Industry P.O. 11.1 The legal relationship between you and us is governed by Swiss law.
11.2 The exclusive place of jurisdiction for legal action against us, Domo Reisen & Vertriebs AG, is Bülach. We can sue the consumer at his place of residence or in Glattbrugg / Bülach.
The prices include VAT at the currently applicable rate for the domestic portion.
